Terms of Service

These Terms of Service (“Terms”) govern your use of SAM (Smart Assistant Manager) and the website at samfantasy.com (collectively, the “Service”), operated by DP Digital LLC (“DP Digital,” “we,” “us,” or “our”).

By using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. The Service

SAM is an AI-powered fantasy football assistant. It provides informational analysis, start-sit and trade guidance, and notifications related to leagues you choose to link. Features may change as the product develops. Beta access may be limited or invitation-only.

2. Fantasy sports disclaimer

SAM provides fantasy sports entertainment and informational advice only. Analysis, rankings, start-sit guidance, and similar content are not guarantees of player performance, weekly outcomes, or league results. You are solely responsible for your lineup and roster decisions. SAM is not a gambling service and does not facilitate wagering. Outcomes are not guaranteed.

3. Eligibility

You must be at least 13 years old to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.

4. Accounts and linked leagues

When accounts launch, you are responsible for credentials and activity under your account. You may link third-party fantasy platforms (for example Sleeper, Yahoo, or ESPN). Those platforms have their own terms. You authorize us to access league and roster data needed to provide SAM features you enable.

5. Acceptable use

You agree not to:

• Abuse, harass, or attempt to disrupt the Service
• Reverse engineer or scrape the Service beyond normal use
• Use the Service for unlawful purposes
• Misrepresent consent for SMS or other communications

We may suspend or terminate access for violations.

6. SMS Program

The following terms apply to the SAM text messaging program. More detail for carrier reviewers is on the SMS Program page.

• Program name: SAM
• Description: Conversational fantasy football assistance and account notifications: injury and inactive alerts, waiver results, lineup reminders.
• Message frequency: Message frequency varies with your usage and your alert settings. Automated alert volume depends on how many leagues you link and which alerts you turn on. On peak days like game days and waiver runs, users with multiple leagues and all alerts enabled may receive 15 or more messages in a day. Automated alerts are never limited or delayed by conversation volume. Reply STOP to cancel at any time.
• Rates: Message and data rates may apply.
• Opt-out and help: Reply STOP to cancel, HELP for help.
• Carrier liability: Carriers are not liable for delayed or undelivered messages.

Consent to receive texts is not a condition of purchase. You currently opt in on the SMS Program page by providing a mobile number and checking the unchecked-by-default consent box. In-app opt-in during account signup arrives with the product launch. Mobile opt-in data and consent are not shared with third parties for marketing. See our Privacy Policy.

7. Intellectual property

The Service, including branding, software, and content we provide, is owned by DP Digital or its licensors. You receive a limited, non-exclusive right to use the Service as offered. You retain rights to content you submit, and grant us a license to use it to operate the Service.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or that advice from SAM will be accurate or complete.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DP DIGITAL LLC AND ITS OFFICERS, DIRECTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

10. Indemnity

You agree to indemnify and hold harmless DP Digital LLC from claims arising out of your misuse of the Service or violation of these Terms.

11. Governing law

These Terms are governed by the laws of the State of Minnesota, without regard to conflict-of-law rules. Courts in Minnesota have exclusive jurisdiction, except where applicable law requires otherwise.

12. Changes

We may update these Terms. The effective date will change when we do. Material changes may be communicated by posting on the site or by email when we have your address. Continued use after changes means you accept the updated Terms.
